1. Introduction

These Terms & Conditions apply to all driving lessons, Essential Driver Training (EDT) lessons, pre-test lessons, vehicle hire, mock assessments, and related services provided by DriveAbility IE.

By booking lessons, packages, or using any of our services, you agree to be bound by these Terms & Conditions.

These terms are designed to ensure safety, professionalism, fairness, and a consistent learning experience for all students.


2. Bookings & Payments

All lessons and services must be booked in advance.

Bookings are confirmed once payment has been received and the student receives a confirmation email or message from DriveAbility IE.

To secure a lesson, payment must be received at the time of booking. For lessons booked well in advance, payment must be received no later than 5 days before the agreed lesson date. Lessons booked within 5 days of the scheduled time require immediate payment.

Accepted payment methods include cash, Revolut, Stripe, and other methods offered through our booking platform.

DriveAbility IE reserves the right to refuse or cancel bookings where necessary.


3. Learner Permit & Legal Requirements

Students must hold a valid Irish Learner Permit or Driving Licence appropriate for the vehicle category being used.

Students must carry their physical permit or licence card during every lesson. Digital copies, photographs, or expired permits are not accepted for tuition purposes.

It is the student’s responsibility to ensure their permit remains valid and in date. Lessons unable to proceed due to missing, incorrect, or expired documentation will be charged in full.

Students must wear suitable footwear and clothing appropriate for safe vehicle operation.


4. Cancellation & Rescheduling Policy

DriveAbility IE operates a strict 48-hour cancellation policy.

At least 48 hours’ notice is required to cancel or reschedule any lesson.

Lessons cancelled with less than 48 hours’ notice will be charged in full. For prepaid block bookings, one lesson session will be deducted from the remaining balance.

Failure to attend a scheduled lesson without notice will result in the full lesson fee being charged.

Students booking through our online booking platform may reschedule lessons using the link provided in their confirmation email, provided the required notice period is met.

DriveAbility IE reserves the right to cancel or reschedule lessons due to:

  • Severe weather conditions
  • Vehicle breakdown or mechanical issues
  • Instructor illness
  • Hazardous road conditions
  • Circumstances outside our reasonable control

Where possible, an alternative lesson time will be offered. If rescheduling is not possible, a refund for the affected prepaid lesson will be issued upon request.

The instructor also reserves the right to terminate a lesson early where road safety is compromised.


5. Punctuality & Late Arrivals

If the instructor is delayed due to traffic, road incidents, or a preceding driving test, the student will be informed as soon as possible. Any lost lesson time will be added to the lesson or rearranged.

If a student arrives late, the lesson will still finish at the originally scheduled time to avoid delays for subsequent students.

Lost lesson time due to student lateness will not be refunded or extended.


6. EDT Lessons

Students booking Essential Driver Training (EDT) lessons are responsible for ensuring:

  • Their learner permit is valid and physically present
  • Their logbook or EDT app details are accurate
  • Lessons are attended in the correct sequence where applicable

EDT lessons will only be uploaded to the RSA portal once the lesson module has been fully completed in accordance with RSA guidelines.


7. Student Responsibilities

Students must:

  • Follow all instructions provided by the instructor
  • Drive responsibly and safely at all times
  • Comply with all Irish road traffic laws
  • Inform the instructor of any medical condition, injury, fatigue, or medication that may affect driving ability

DriveAbility IE reserves the right to refuse or terminate lessons where a student:

  • Appears under the influence of alcohol or drugs
  • Behaves aggressively or inappropriately
  • Is considered medically or physically unfit to drive safely

In such cases, the lesson fee remains payable and non-refundable.

Students are responsible for their personal belongings during lessons. DriveAbility IE accepts no responsibility for lost, stolen, or damaged personal items.


8. Use of Customer Vehicles

Certain refresher, advanced, or specialist lessons may be conducted in the student’s own vehicle.

The student is responsible for ensuring the vehicle is:

  • Fully insured
  • Properly taxed
  • NCT compliant where applicable
  • Roadworthy and safe to drive
  • Fitted with legally required L-plates or N-plates where applicable

Lessons may be refused if the vehicle is considered unsafe, unroadworthy, or not legally compliant.

DriveAbility IE accepts no liability for issues arising from the use of a student-owned vehicle.


9. Driving Test Vehicle Hire

Vehicle hire for the RSA driving test is provided at the discretion of DriveAbility IE and is treated as a separate service.

To use the school vehicle for a driving test, students must:

  • Be considered test-ready by the instructor
  • Hold all required documentation
  • Complete sufficient preparation or assessment lessons where requested

DriveAbility IE reserves the right to refuse use of the vehicle where:

  • The student is not considered ready for test standard
  • Safety concerns exist
  • Required documentation is missing

RSA driving test fees remain the responsibility of the student.

DriveAbility IE cannot guarantee that a student will pass their driving test or obtain a driving licence.


10. Payments, Refunds & Block Bookings

Payments and prepaid lesson packages are generally non-refundable once booked.

Refund requests may be considered only in exceptional circumstances and at the sole discretion of DriveAbility IE.

Block bookings and prepaid lesson packages must be used within 12 months of purchase unless otherwise agreed in writing. Unused lessons after this period may expire without refund.

Lessons, packages, and bookings are non-transferable unless agreed in advance.

Gift vouchers:

  • Are non-refundable
  • Cannot be exchanged for cash
  • May be used across multiple bookings until the balance is exhausted
  • Expire 5 years from the original purchase date in accordance with Irish consumer law

11. Instructor Availability

DriveAbility IE reserves the right to assign an alternative instructor or replacement vehicle where necessary due to illness, holidays, maintenance, scheduling, or operational requirements.


12. Safety, Penalties & Liability

Driving lessons involve practical on-road driving and students participate at their own risk.

Students are responsible for complying with all road traffic laws during lessons. Any fines, Fixed Charge Notices (FCNs), penalty points, or legal penalties arising from the student’s actions may become the responsibility of the student where permitted under Irish law.

Where damage is caused to the school vehicle due to reckless behaviour, negligence, or failure to follow clear safety instructions, DriveAbility IE reserves the right to recover reasonable repair costs.

DriveAbility IE accepts no liability for:

  • RSA driving test cancellations
  • Traffic delays or road closures
  • Mechanical failures outside reasonable control
  • Indirect or consequential losses

Nothing in these Terms excludes liability where exclusion is not permitted under Irish law.


13. Website Use & Intellectual Property

DriveAbility IE is an Irish-owned business registered in Ireland under CRO number 737966.

All website content, including text, branding, logos, images, graphics, reviews, videos, and social media content, remains the property of DriveAbility IE unless otherwise stated.

Content may not be copied, reproduced, republished, or distributed without prior written permission.

While every effort is made to ensure website information is accurate and up to date, DriveAbility IE accepts no liability for temporary errors, omissions, or website unavailability.


14. Privacy & GDPR

Personal information provided during bookings, enquiries, or communications will be processed in accordance with our Privacy Policy and applicable GDPR regulations.

By using our services, you consent to the collection, storage, and processing of relevant personal data required for lesson administration, RSA lesson logging, and customer communication.


15. Changes to Terms & Conditions

DriveAbility IE reserves the right to update or modify these Terms & Conditions at any time without prior notice.

The latest version will always be available on our website.
